The NBA legend Testifies He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle

The basketball icon, introducing himself formally in a federal courtroom on Friday, stated that his competitive side and status as a newcomer motivated his effort with 23XI Racing to “challenge” Nascar over alleged violations of competition laws.

Team Investment and a Will to Win

The owner disclosed operational insights of his racing venture, revealing he invested $40 million of his personal wealth into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.

“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at through a new lens.”

The Core Dispute: Charter Agreements and Renewal Demands

The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other major leagues with independent franchises, such as the Charlotte Hornets or the NFL’s Panthers. The agreement was set to expire in 2024 when Nascar insisted on charter membership renewals.

Jordan was on the witness stand for about sixty minutes and exited the courthouse to a media frenzy, with fans and media clamoring for a glimpse or a photo of the global icon.

Leading the Legal Charge

Jordan’s 23XI is leading the full-court press along with another racing team for Nascar to change a business model Jordan contended is unlawful to keep two hands on the wheel.

For Jordan and and a fellow team representative, who preceded Jordan, are events from September 2024. Gibbs described a frantic and emotional six hours where the racing circuit informed teams they had to sign a charter agreement extension. This agreement spanned over a hundred pages outlining pay for chartered teams and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan explained that his team and its ally concluded their only feasible option was to decline to sign that 112-page package and take the issue to court. All other teams signed the agreement.

The team owners reached out to Nascar about possible changes or extension options. Nascar refused to engage, Jordan said.

The Ultimate Motivation: Winning

Ultimately, the pushback against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Success.

“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, sharing that he purchased another franchise last year for $28 million despite the uncertainty. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, which she said a formal letter to Nascar. She testified the timing of the signature deadline was problematic.

She said, the team founder first attempted to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, that’s what I have. If there are 30, I have 30.”
